Why FSMA compliance affects UK food exporters
The FDA Food Safety Modernization Act applies to any facility that manufactures, processes, packs, or holds food for consumption in the United States — including UK exporters. Non-compliance means your shipments can be detained at the border, and repeated violations can lead to your facility being placed on an import alert, effectively banning your products.
FSMA is fundamentally different from UK food safety law. It requires HARPC — Hazard Analysis and Risk-Based Preventive Controls — rather than the HACCP approach you use for UK and EU compliance. The key difference: HARPC requires you to identify hazards that are 'reasonably foreseeable', including intentional adulteration and economically motivated fraud, which traditional HACCP does not address.
Using this checklist for FSMA readiness
Work through each section with your quality assurance team. You will need a qualified preventive controls individual — someone who has completed FDA-recognised training or has equivalent job experience. The checklist covers hazard analysis, preventive controls, supply chain verification, recall planning, and your food safety plan reanalysis schedule.
